Welcome to DMV Hero, and thanks for using our app to prepare for your permit or license test. These Terms of Service ("Terms") explain the rules for using DMV Hero (the "App"), written as clearly as we can manage. By downloading, installing, or using the App, you're agreeing to these Terms, so please take a few minutes to read them.
1. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your own personal, non-commercial use in studying for a driver's permit or license. This license does not give you any ownership interest in the App.
2. Your Use of the App
No account or sign-up is required to use the App. Your study progress, settings, and history are stored locally on your device, as described in our Privacy Policy. An internet connection is used for displaying ads, optional analytics, and any optional feedback or issue reports you choose to submit, but core studying features are designed to work without one.
3. Acceptable Use
When using the App, you agree not to:
- Reverse-engineer, decompile, disassemble, or extract the App's content for resale or redistribution
- Use the App for any unlawful purpose or in a way that violates any applicable law or regulation
- Attempt to disrupt, interfere with, or gain unauthorized access to the App, its content, or the services it relies on
- Use automated means (bots, scrapers, or similar tools) to access or extract data from the App
- Interfere with the display of advertisements or the collection of anonymous analytics described in our Privacy Policy
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity, including any DMV or government agency
4. Content and Intellectual Property
The App's design, software, and original written content are owned by the developer or its licensors and are protected by copyright, trademark, and other intellectual property laws. The "DMV Hero" name and logo are trademarks of the developer and may not be used without permission. Road sign designs referenced in the App are based on the federal Manual on Uniform Traffic Control Devices (MUTCD), a public standard, and are used for educational reference only.
5. Feedback and Submissions
If you submit feedback, an issue report, or any other comments through the App (for example, through the Report an Issue or Feedback features), you grant us a worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, and act on that feedback to improve the App, without any obligation to compensate or credit you. Please don't submit anything unlawful, abusive, or that infringes someone else's rights.
6. Third-Party Services
The App uses third-party services, including Google Firebase, Google AdMob, RevenueCat, Apple App Store billing, and Google Play billing, to provide analytics, crash reporting, advertising, payment processing, purchase verification, and purchase restoration. Your use of those features is also subject to the relevant third party's terms. We do not control, and are not responsible for, the availability, content, or practices of those third-party services.
7. Free Access and Premium Purchases
DMV Hero includes free, ad-supported access. Free-access limits and available content may be described inside the App and may change as the App evolves. Optional Premium access removes ads and practice-life limits and unlocks unlimited mock exams and the full Coach roadmap for currently available car-permit content. Required learning prerequisites still apply.
Premium is offered as a monthly auto-renewing subscription or a non-consumable Lifetime purchase. The monthly subscription renews each month unless you cancel through your Apple App Store or Google Play subscription settings before renewal. Cancellation stops future renewals; access continues through the end of the paid billing period. Lifetime requires one payment and does not renew. Prices and applicable taxes are shown by your app store before you confirm a purchase.
Purchases are charged to your app-store account and are subject to that store's payment, cancellation, and refund rules. We do not directly process payments or control refund decisions. A refund, revocation, subscription expiration, or billing failure may remove Premium access. Restore Purchases requires the same store account used for purchase. Purchases do not automatically transfer between Apple and Google stores. Restoring purchases does not restore locally stored study progress.

8. Not an Official DMV Product
The App is an independent, privately developed study and practice tool. It is NOT affiliated with, endorsed by, sponsored by, or connected in any way to any State Department of Motor Vehicles (DMV), Department of Public Safety (DPS), Motor Vehicle Division or Administration, or any other government agency of any U.S. state or the federal government. State names and abbreviations are used only to organize study content by state and do not imply any official affiliation or endorsement.
Content in the App is based on publicly available official state driver handbooks. To find your state's official DMV website and verify current requirements, use the U.S. government's own directory: usa.gov/motor-vehicle-services.
9. Educational Purposes Only — No Guarantee of Passing
The App is provided for educational and self-study purposes only. Practice questions, mock exams, lessons, and related content are meant to help you study and are based on our understanding of general driving knowledge and publicly available handbook information believed accurate at the time it was written. Using the App, completing practice questions, or passing mock exams within the App does NOT guarantee that you will pass any official written knowledge test, driving skills test, or any other examination administered by your state's DMV or equivalent agency. Actual exam content, format, difficulty, and passing requirements are determined solely by your state and may differ from the App's content.
10. Rules and Laws Can Change
Traffic laws, licensing requirements, and DMV rules and procedures can change at any time, without notice, and can vary by state, county, or city. We make reasonable efforts to keep content accurate as of when it was written, but we do not guarantee that any information in the App reflects the most current laws or requirements. You are solely responsible for verifying current rules, requirements, and procedures directly with your state's official DMV (or equivalent agency) before you rely on them, take any test, or operate a motor vehicle.
11. No Legal or Professional Advice
Nothing in the App constitutes legal advice. The App is not a substitute for your state's official driver handbook, official practice materials, or professional instruction.
12. Disclaimer of Warranties
THE APP AND ALL OF ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT ANY CONTENT IS CURRENT, COMPLETE, OR ACCURATE. THIS INCLUDES CONTENT AND ADVERTISEMENTS SUPPLIED BY THIRD-PARTY SERVICES DESCRIBED IN SECTION 6.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER OF THE APP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, EXAM FEES, OR OPPORTUNITY, ARISING FROM OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) FAILING ANY WRITTEN OR DRIVING TEST; (C) RELIANCE ON ANY CONTENT IN THE APP; (D) ANY TRAFFIC VIOLATION, ACCIDENT, INJURY, OR LEGAL CONSEQUENCE ARISING FROM YOUR OPERATION OF A MOTOR VEHICLE; OR (E) ANY CHANGE IN, OR INACCURACY OF, DMV RULES OR LAWS. THIS APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT VALIDLY DISCLAIMED, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (II) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify, defend, and hold harmless the developer of DMV Hero from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of a third party; or (d) any traffic violation, accident, injury, or legal consequence arising from your operation of a motor vehicle.
15. Dispute Resolution and Governing Law
If a dispute arises, we'd appreciate the chance to resolve it informally first — please contact us at the email below before pursuing any other action. These Terms, and any dispute arising out of or relating to them or the App, are governed by the laws of the United States and the state in which the developer is based, without regard to conflict-of-law principles, except where local law requires otherwise. You agree that any legal action or proceeding not resolved informally will be brought exclusively in the courts located in that state, and you consent to the jurisdiction of those courts.
16. Force Majeure
We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, internet or power outages, or failures of third-party services the App relies on.
17. Age Requirement
The App is intended for users old enough to be studying for a learner's permit or driver's license in their state, and for parents or guardians assisting them. If you are under the age required by your app-store platform to accept these Terms yourself, a parent or guardian should review and accept these Terms on your behalf.
18. Changes to the App or Terms
We may update, modify, or discontinue the App or any part of it, and may update these Terms, at any time. Changes will be reflected by updating the effective date above. Continuing to use the App after changes take effect means you accept the revised Terms.
19. Termination
You're free to stop using the App at any time, simply by uninstalling it. We may suspend or discontinue your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App generally.
20. General Provisions
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, make up the entire agreement between you and us regarding the App and supersede any prior agreements. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms without restriction.
